How to Measure Your Setbacks Correctly

A setback is the horizontal distance a structure must keep from a property line. The definition is simple; the arguments are not. Most setback disputes that reach a planning counter are not disagreements about the rule โ€” they are two people measuring from different starting points. Measure from the kerb and you will under-measure on most lots. Measure from an old fence and you may be measuring from something a previous owner placed in the wrong spot years ago.

What a setback actually measures

A setback runs horizontally from the property line to the nearest part of the structure. It is a map distance, not a walking distance, and it is not measured along the slope of the ground. If your yard falls away steeply, the distance you would measure with a tape dragged down the hill is longer than the setback distance the code cares about.

The second thing that surprises people is what counts as part of the structure. Roof overhangs, bay windows, stairs, landings and often air-conditioning pads are treated as part of the building for setback purposes in many codes, even though they never touch the ground. A shed placed exactly at the setback line can still be non-compliant once its overhang is counted, which is a common reason a compliant-looking project fails a final inspection.

Setbacks are also applied per yard rather than per lot. Front, side, rear and corner-side yards each carry their own number, and a corner lot usually has two front yards rather than one. The setback that governs your project is the one for the yard you are building in, not the smallest or the largest number on the page.

Where the line actually is โ€” and where it is not

The property line is a legal description, not a visible feature. Everything you can see in a typical yard is an approximation of it, and several of the things people measure from are reliably wrong.

  • The kerb, the sidewalk and the street pavement usually sit inside a public right-of-way that extends well beyond the road surface. Measuring from the kerb can understate your front setback by ten feet or more.
  • A fence is evidence of where an owner believed the line was, not of where the line is. Fences are frequently built inside the line to avoid a dispute, and sometimes across an easement.
  • A hedge, a line of trees or a mowing edge carries no legal weight at all, no matter how long it has been there.
  • A utility easement is not a property line. Easements run through your land, so building inside one can be lawful for zoning purposes while still being a problem for the utility that holds the easement.

How to find your line without paying for a new survey

If your closing documents included a survey or a plat, start there. A recorded plat shows the lot dimensions and the bearing of each line, and it is usually available from the county recorder or the county surveyor even when your own copy has gone missing. Many counties also publish parcel outlines in an online GIS viewer, which is useful for orientation but is not a legal survey and should not be used to set a foundation.

The most direct evidence is the survey monument itself: a metal rod, a capped pipe or a concrete marker set at each lot corner, often driven flush with the ground or a little below it. A cheap metal detector will find one in a few minutes once you know roughly where to look, and finding two corners lets you string a line between them. If the monuments are missing, that is the point at which a survey stops being optional โ€” particularly if your project will sit close to the line or if a neighbour has already questioned the boundary.

Where the stakes are high, an agreed boundary is worth more than an argued one. A boundary line agreement with the adjoining owner, recorded properly, resolves the question for both properties and for future buyers, and it usually costs far less than the dispute it prevents.

Corner lots, through lots and double frontage

A corner lot is the most commonly mishandled case. Because it fronts two streets, most codes treat both street frontages as front yards, which means the deeper front setback applies on both sides and the house has, in effect, no side yard on the street side. The remaining yards are then measured from what is left.

Corner lots also carry a sight-distance triangle, sometimes called a clear-vision area. Within that triangle, typically defined by two legs running back from the intersection along each street, fences, walls, hedges and parked structures above a low height are restricted because they block the view of approaching traffic. The triangle is a separate rule from the setback: a fence can meet every setback on the lot and still be unlawful inside the triangle.

What to measure for each project type

The measurement that matters depends on what you are building, and asking the department the wrong question is a common way to lose a week.

  • Storage shed: distance from the structure, including any overhang, to the rear and side lines, plus the distance to the house. Many codes require accessory structures to sit behind the front wall of the dwelling.
  • Fence: height from natural grade, and separately whether the fence sits inside a sight triangle or crosses an easement. Height and location are two different tests.
  • Deck or patio: the walking-surface height above adjacent grade, which drives both the permit threshold and the guard requirement, and the horizontal distance to each line.
  • Accessory dwelling unit: rear and side setbacks, which several state statutes fix at a specific figure for units below a guaranteed size, plus height and lot coverage.

Take this to your department

  1. Ask the department how the setback is measured on your lot: from the property line to the structure, including or excluding overhangs.
  2. Ask which yards apply to your parcel, and whether it is treated as a corner lot with two front yards.
  3. Find your survey monuments or request the recorded plat from the county before you set any corner.
  4. Measure horizontally, not along the slope, and confirm whether height is measured from natural or finished grade.
  5. Check for easements and sight-distance triangles, which are separate from the setback rules.
  6. If a neighbour disputes the line, ask about a recorded boundary line agreement before you build.

Frequently asked questions

Can I measure from my existing fence to find the setback?

Only as a rough guide. A fence shows where someone once believed the line was, and fences are often built a foot or two inside it to avoid arguments. For anything close to the line, use the recorded plat or the survey monuments, and order a survey if the monuments are missing.

Does a roof overhang count toward the setback?

In many codes, yes. Overhangs, bay windows, stairs, landings and sometimes mechanical pads are treated as part of the structure for setback purposes. Ask the department whether your project is measured to the wall or to the widest projection, because that single question decides a lot of borderline cases.

My lot slopes. Do I measure along the ground?

No. Setbacks are horizontal map distances. Dragging a tape down a slope gives a longer figure than the code uses. Height is the measurement that interacts with slope, and it is usually taken from the grade adjacent to the structure, so confirm whether your code uses natural grade or finished grade.

Do I have two front yards on a corner lot?

Most codes treat both street frontages of a corner lot as front yards, so the deeper front setback applies twice. Ask the planning department to confirm the yard designations for your parcel in writing, and check whether a sight-distance triangle restricts structures near the intersection.
